1. About these terms
These Terms of Use govern your access to and use of the website at www.thefund.africa (the “Website”), which presents a pro forma concept for Africa Fund. The Website is operated by the sponsor of the Africa Fund, a proposed collective investment scheme, (“we”, “us”, or “our”). By signing in, you agree to these terms, the Important Notice on the sign-in page, and our Privacy Policy. If you do not agree, do not sign in.
2. Who may use the Website
The Website is available only to individuals we have invited and given a username and password. You must be at least 18 years old and must use the Website only for your own information in connection with the discussions for which you were invited.
3. Your credentials
Your username and password are personal to you. You must keep them confidential, must not share them with anyone, and must tell us promptly if you believe they have been disclosed. We may suspend or withdraw access at any time, for any reason, without notice.
4. Information only; no offer or advice
The Website is provided for information and discussion only. Nothing on it is an offer, solicitation, recommendation, or advice of any kind, and nothing creates any obligation on us or on you. The Africa Fund is a proposed collective investment scheme. It has not been incorporated, licensed, or approved by the Capital Markets Authority of Uganda or any other regulator, and no units, shares, or other interests in it are being offered. Any future offer would be made only by a prospectus approved by the Capital Markets Authority. All figures, projections, and examples are illustrative, and the Important Notice on the sign-in page forms part of these terms.
5. Confidentiality
The content of the Website is confidential. You must not copy, download, record, photograph, screenshot, publish, forward, or otherwise disclose any part of it to anyone without our prior written consent, and you must use it only for the purpose for which you were invited. This obligation continues after your access ends.
6. Acceptable use
You must not attempt to gain unauthorised access to the Website or its systems; probe, scan, or test its security; use automated tools to access, copy, or scrape it; interfere with its operation; or use it for any unlawful purpose.
7. Intellectual property
The content, design, text, graphics, data, and code of the Website belong to us or our licensors. Photographs are used under the Unsplash licence. No licence or right is granted to you except to view the Website in accordance with these terms.
8. Third-party names and links
References to governments, regulators, development institutions, companies, and other organisations are for illustration only and do not imply any endorsement, participation, or relationship. We are not responsible for any third-party website or content.
9. Disclaimer of warranties
The Website is provided “as is” and “as available”, without any representation or warranty, express or implied, including as to accuracy, completeness, or fitness for any purpose. We do not guarantee that the Website will be uninterrupted, secure, or free of errors.
10. Limitation of liability
To the fullest extent permitted by law, we and our directors, officers, employees, advisers, and agents are not liable for any direct, indirect, or consequential loss or damage arising from your use of, inability to use, or reliance on the Website. Nothing in these terms excludes liability that cannot be excluded by law.
